This Privacy Policy (Policy) sets out how Barward Construction Services Pty Ltd ACN 39 630 500 695 trading as Kubby (Kubby, we, our, us) handles personal information and acknowledges Kubby’s obligations under the Privacy Act 1988 (Cth) (Privacy Act).

Other policies may apply instead of, or in addition to, this Policy in certain circumstances. We will let you know if that is the case.

Please note that in some circumstances, there are exemptions or exceptions to the Privacy Act that may apply to Kubby, including in relation to the handling of employment related personal information. Nothing in this Policy is intended to limit the operation of those exemptions or exceptions to Kubby or otherwise restrict us from handling personal information in a manner that would be otherwise be permitted by law.

By using our website at www.kubby.com.au and/or providing us with your personal information, you acknowledge that Kubby will handle your personal information as set out in this Policy.

 

Collection of your personal information

We may collect personal information that we require for the purposes of operating and managing our business activities and functions and as required or permitted by law. We may also collect personal information from you in connection with other dealings you may have with us, such as if you make a general enquiry with us, sign up to our news releases or apply for a position with Kubby or as otherwise required or permitted by law.

The type of personal information we collect will depend on your dealings with us. Generally, we collect your contact details such as your name, address, email and phone number.

If you are a customer of our business and user of our Kubby web application, we may also collect information about the services you use, any project you commence, your financial situation and other relevant information as permitted or required by law.

If you are an independent professional contractor engaged to provide services to customers through our platform, we may collect details about your qualifications, work experience, insurance coverage, bank account details, trade union memberships or associations and other details relevant to your provision of services.

We may also collect personal information about the contractors, suppliers and employees that we engage, and deal with in relation to the provision of our services.

We may collect your personal information in a variety of ways, such as in person, by telephone, by email and by other electronic means (such as through our platform when you use our services). Where practicable, we collect your personal information directly from you. From time to time, we may collect personal information about you from third parties (for example, from publicly available sources, our agents, our contractors or as otherwise required or authorised by law). 

We also collect your personal information if you make telephone calls to, or receive telephone calls from, Kubby. Personal information that you provide during telephone calls may be held in digital telephone recordings. Your express consent to recording of telephone calls is contained within our Terms and Conditions.

From time to time, we may collect sensitive information about you. We collect sensitive information when you provide it to us, with your consent or where otherwise permitted by law.

If you provide us with personal information about a third party, you represent, and we collect it on the basis that, you have that person’s consent for us to collect and handle their personal information in accordance with this Policy.

If we are unable to collect the personal information we require, or the information provided is incorrect or incomplete, this may affect our ability to provide our services to you or the information you seek from us.

  • for staff training. Helping us to improve our services and product, and to ensure that information provided is consistent and accurate;
  • to identify ways that we can continually improve and simplify the services we provide to you; and
  • as an accurate record and supporting evidence in the event of disputes, disagreements or complaints.

 

Sharing of your personal information

We may disclose and share your personal information to independent contractors and third party service providers for the reasons described above and including but not limited to, providing services to you, handling customer support enquiries, processing transactions, connecting you with providers to obtain finance, customer freight shipping or consultancy.

We may also disclose and share your personal information with our related entities, contractors, service providers, promotion partners for the purposes set out above and as otherwise permitted or required by law.

In addition, you may also be directed to provide your personal information to third parties in order to enable your use of our services and/or platform.

We may also share your personal information with finance providers where you have indicated that you require finance for a particular project. The finance provider’s storage and use of your personal information will be dealt with in accordance with their privacy policy.

Generally, we will not disclose your personal information to overseas recipients. However, in some cases it may be necessary, and we may disclose personal information we hold about you to recipients who are located outside of Australia where permitted by law.

For each visitor to our website at www.kubby.com.au, we collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information using cookie technology. This is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalized content to you while you are at this site.

If you do not wish to receive any cookies you may set your browser to refuse cookies.  This may mean you will not be able to take full advantage of the services on the website.

In addition, our website may contain links to third party websites. These linked sites are not under our control nor are those sites subject to this Policy.  We are not responsible for the privacy, security or handling of your personal information via those websites.  You should review the privacy policy and terms of use for those websites each time you visit them.

 

Access and correction of your Personal Information

You may lodge a request to correct personal information we hold about you if you believe it is inaccurate, incomplete, out-of-date, irrelevant or misleading, in which case please contact us via the details listed below.

Generally, we will provide you with access, except in limited circumstances where the law permits us to refuse, or prevents us from give you, access to the personal information we hold about you. Where we agree to provide you with access to your personal information, we may make this conditional on us recovering our reasonable costs of doing so.  No fee will be incurred for requesting access, but if your request for access is accepted, you will be notified of any fee payable for providing access if you proceed with your request.
